LICENSE AND USE OF SOFTWARE

Arrows Connect authorise you to create a user account and use the Software to log your reflective practice (otherwise known as "Content”) on all Continuous Professional Development (CPD) activities, keeping all Content in line with the Health and Care Professions Council CPD standards. Subscribers are also granted access to engage in discussion forums and discuss appropriate topics with other users. These forums will be monitored and topics added to the forum are required to be approved by Arrows Connect administration team. We would appreciate subscribers notifying us of any content they find offensive or inappropriate and we will respond appropriately.

Within the Software, subscribers are able to upload Content and evidence however all uploads must be appropriate to the site. Arrows Connect can remove any Content from the site at any time if deemed inappropriate. Person-identifiable information, wherever possible, must remain anonymous.

Exclusive discounts are available for new users. Discount codes are required to be entered when subscribing to the site. Once the discount period runs out, the subscriber will be automatically transferred to the full software package.

WARRANTIES AND LIABILITY

THE SOFTWARE AND ITS CONTENT ARE WITHOUT WARRANTY OF ANY KIND. YOU ACKNOWLEDGE THAT ARROWS CONNECT OR ANY PARTIES INVOLVED IN THE DEVELOPMENT OF THE SITE MAKE NO GUARANTEES OR WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT AND THAT THE SOFTWARE WILL BE FREE OF ERRORS.

ARROWS CONNECT WILL MAKE NO REPRESENTATIONS OR WARRANTIES THAT THE USE OF THIS SITE WILL BE UNINTERRUPTED OR ERROR FREE. YOU ARE RESPONSIBLE FOR TAKING ALL PRECAUTIONS NECESSARY TO ENSURE THAT ANY CONTENT YOU OBTAIN FROM OR PROVIDE ON OUR SITE IS FREE OF VIRUSES AND OTHER COMPUTER PROGRAMMING ROUTINES OR ENGINES THAT ARE INTENDED TO DAMAGE, DETRIMENTALLY INTERFERE WITH OR EXPROPRIATE ANY SYSTEM, DATA OR INFORMATION.

TO THE FULLEST EXTENT PERMITTED BY LAW, THESE WARRANTIES ARE EXCLUSIVE AND THERE ARE NO OTHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE.

NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE LOSS OF ANTICIPATED BENEFIT, BUSINESS INTERRUPTION OR MANAGEMENT TIME FROM THE USE OF THE SOFTWARE. EXCEPT FOR BREACH OF CONFIDENTIALITY OR INDEMNIFICATION OBLIGATIONS, ARROW CONNECT MAXIMUM LIABILITY FOR ANY DAMAGES UNDER THESE TERMS AND CONDITIONS, WHETHER IN CONTRACT OR TORT, SHALL BE LIMITED TO THE ANNUAL FEES YOU PAYARROW CONNECT.

PERSONAL INFORMATION AND SUBMITTED CONTENT

To register/subscribe to the Software, you are required to provide personal information. It is your responsibility to maintain and update, including, without limitation, your registration details (email and password) to ensure all information is current, accurate and complete. You acknowledge and agree that you are solely responsible for the form, content and accuracy of any information provided by you on this site. If you create an account, you are required to establish a login name and password and you are responsible to maintain the confidentiality of this information. When engaging in discussion forums, the subscriber’s username will be used to identify the contributor to the forum topics in order to maintain confidentiality. It is the subscribers responsibility to choose a suitable username which they are happy to be identified by within discussion forums and the rest of the site. You agree to notify Arrows Connect of any breach of security. You agree to log off the Software at the end of each session. Arrows Connect is not liable for any loss or damage of contentfrom your failure to adhere to these requirements.

You agree that all content on your personal account is appropriate for the Software. Data can be removed by Arrows Connect if content is deemed inappropriate. You have the responsibility to maintain confidentiality within all reflections added onto the site to ensure individuals and locations cannot be identified. Arrows Connect will monitor this and remove Content if confidentiality is not maintained. Users will be notified by a team member to highlight this issue. Shared Content will be approved by Arrows Connect before being added onto the Content bank. Arrows Connect have the right to terminate a user’s account if they do not adhere to these requirements. Users will be notified through email if terminated from using the Software.

SOFTWARE UPDATES

The Software will require regular software updates to ensure the programme is working effectively and efficiently, providing a high quality service. Software updates may affect the subscription costs due to new features being added and developed in the Software. Each user will be informed of change in subscription costs one month before the cost changes, and will have the right to terminate their subscription as a result of this change if they no longer wish to continue their subscription package.

Support is available from Arrows Connect if you are having difficulty accessing the Software or have enquiries regarding the use of the Software. Please contact us on enquiries@arrowsconnect.com. If you wish to report any problems with the Software and wish to provide feedback regarding the Software programme, please contact Arrows Connect on the email address provided above and one of our team members will reply as soon as possible. Arrows Connect appreciate all feedback received regarding the Software programme to continue to provide a high standard service to all users.

DATA PROTECTION

Please review our Privacy Policy. You acknowledge and agree to the use of your data in accordance with our Privacy policy. All data is securely stored meeting the requirements of the Data Protection Act.

TERMINATION

Arrows Connect, in its sole discretion, reserves the right to decline, suspend, terminate, alter, and/or modify your access to this site and any and all Content on this site at any time and for any reason, including those within this document, and any indicated in our Privacy Policy. If we believe your conduct or any information you provide on this site materially fails to conform to the Terms and Conditions, we reserve the right to investigate, involve, report to and cooperate with law enforcement, governmental, or other action for any alleged or actual illegal, fraudulent, or other unauthorised activities involving this site or any of the services provided herein with or without notice. Any report made to law enforcement, governmental, or other authorities may be made without notice to you. However, subject to our discretion or where complied to do so, we may notify you of termination of your access to the Software via email you provide us on the sign-up process. After the termination, you will not be authorised to access or use the Software, and you shall cease all such access and use. Upon termination, you agree to immediately discontinue your use of the Software and destroy all content obtained on it.

Users are required to provide 30 days’notice to terminate subscription from the Software. Users information will not be held following the termination of their use of the Software.

Users are required to pay their subscription cost on their chosen date agreed when subscribing to the Software. Users have seven days following notification of their payment date to pay their subscription cost. Failure to pay within this timeframe will result subscription being terminated.

SEVERANCE

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable in any respect, then the Court may modify it to make such provision enforceable or in the alternative remove it without affecting the rest of these Terms and Conditions. The remaining provisions of these Terms and Conditions will continue to be valid and enforceable.

COPYRIGHT

United Kingdom copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the Software. Arrows Connect owns all title and copyrights in and to the Software, the accompanying printed materials, and any copies of the Software.

MODIFICATIONS

Arrows Connect reserves the right to add or change this site and the Terms and Conditions and any other policies governing the use of the Software at any time. Any changes will be posted on the Software site and it is your responsibility as a user to ensure that you are aware of any such changes and are deemed to be apprised of and bound by and changes made.

Scottish law governs these Terms and Conditions and both you and Arrows Connect agree to submit to the exclusive jurisdiction of the courts of Edinburgh in any dispute arising out of or relating to this EULA.

These Terms and Conditions constitute the whole legal agreement between you and Arrows Connect (UK) Ltd and govern your use of the Software programme and any content and completely replace and supersede any prior agreements between you and Arrows Connect (UK) ltd, whether written or oral, in relation to the Software or any other service thereof.
